These Terms & Conditions (“Terms”) govern your use of the website www.namika.in (“Website/Platform”). By accessing or purchasing from Namika Creations (“We”, “Us”, “Our”), you (“You”, “User”, “Customer”) agree to be legally bound by these Terms. If you do not agree, please discontinue use immediately.

These Terms are enforceable under Indian law and are designed to protect the interests of Namika Creations, a Sole Proprietorship operating from the address mentioned herein.

2. ELIGIBILITY

2.1 You must be at least 18 years old to make purchases.
2.2 Minors (below 18) may use the website only under the supervision of a parent/guardian who accepts full responsibility.


3. PRODUCTS & REPRESENTATION

3.1 We sell anti-tarnish jewellery, waterproof jewellery, Korean style jewellery, and hair accessories, handcrafted or machine-made.
3.2 Product images are for representation; actual color, shine, size, or tone may vary due to screen settings, lighting, and manufacturing differences. These variations are not considered defects.
3.3 Anti-tarnish jewellery carries a 6-month color warranty, subject to proper use (refer Clause 9).


4. PRICING & PAYMENTS

4.1 Prices listed on the Website are in Indian Rupees (INR).
4.2 Prices and offers may change without prior notice.
4.3 Payments are processed through third-party payment gateways; we are not liable for payment failures, gateway errors, delays, or technical issues.
4.4 Fraudulent transactions will be reported under relevant Indian cyber and criminal laws.


5. ORDER ACCEPTANCE & CANCELLATION

5.1 An order is confirmed only after you receive an email or SMS confirmation.
5.2 Namika Creations reserves full right to cancel or refuse orders due to:

  • Product unavailability
  • Pricing errors
  • Suspected fraud
  • Incorrect customer information
    5.3 Once the order is processed or shipped, no cancellation is allowed by the customer.

6. SHIPPING & DELIVERY

6.1 We fulfill orders in-house and ship via third-party courier services (to be updated).
6.2 Delivery timelines displayed on the website are estimated, not guaranteed.
6.3 We are not liable for delays caused by courier partners, weather, operational disruptions, or incorrect address details provided by the customer.
6.4 Risk of loss/damage transfers to the customer upon dispatch from our facility.


7. RETURN POLICY

7.1 Returns are accepted only within 48 hours of delivery, subject to approval.
7.2 No Exchange is provided under any circumstances.
7.3 Products must be returned unused, unworn, undamaged, and with all original packaging.
7.4 Returns are not accepted for:

  • Size issues
  • Minor color/texture variations
  • Damage caused by mishandling
  • Breakage after use
  • Exposure to chemicals/perfume
    7.5 Namika Creations reserves full right to reject return claims that appear fraudulent, misused, tampered, worn, or intentionally damaged.

8. REFUND POLICY

8.1 If a return is approved, refunds will be processed only to the original payment method.
8.2 Refund processing timeline depends on the bank/payment gateway and may take 7–14 working days.
8.3 Shipping charges are non-refundable.
8.4 If the customer provides incorrect bank or payment details, Namika Creations is not responsible for refund failures.


9. PRODUCT WARRANTY (IMPORTANT)

9.1 Anti-tarnish / waterproof jewellery includes a 6-month color warranty, applicable only when:

  • Jewellery is not exposed to perfume, deodorant, body sprays, chemicals
  • Jewellery is not exposed to detergents
  • Jewellery is handled, stored, and cleaned as per care instructions

9.2 Warranty is void if discoloration occurs due to:

  • Perfumes or fragrances
  • Chemical exposure
  • Improper storage
  • Rough usage

9.3 Warranty covers color fading ONLY — not breakage, damage, scratches, stone loosening, or physical wear.


10. USER RESPONSIBILITIES

Customers agree NOT to:

  • Misuse the website for fraudulent activities
  • Upload harmful content or malware
  • Engage in chargeback fraud
  • Abuse return/refund policies
  • Provide false shipping or personal information
  • Violate any Indian law while using the Website

Violation may result in account suspension and legal action.


11. INTELLECTUAL PROPERTY

11.1 All content, designs, logos (including the crown logo), product images, descriptions, videos, and branding on the Website are the exclusive intellectual property of Namika Creations.
11.2 Unauthorized usage, reproduction, distribution, or commercial exploitation is strictly prohibited and may lead to legal action under Indian Copyright Act and IT Act.


12. LIMITATION OF LIABILITY

To the maximum extent permitted by Indian law, Namika Creations is not liable for:

  • Indirect, incidental, or consequential damages
  • Losses due to courier delays
  • Emotional dissatisfaction
  • Damages arising from misuse of jewellery
  • Third-party service failures (courier/payment gateway)
  • Any claims exceeding the value of the purchased product

Total liability shall not exceed the product purchase price.


13. INDEMNITY

You agree to indemnify, defend, and hold Namika Creations harmless from any claims, losses, damages, legal costs, or disputes arising from:

  • Your misuse of the Website
  • Violation of these Terms
  • Any breach of law
  • Submission of false/fraudulent information

14. THIRD-PARTY LINKS

We are not responsible for content or actions of external websites linked from our platform. Accessing them is entirely at your own risk.


15. GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of India.
Any disputes shall be subject to the exclusive jurisdiction of the Courts of Delhi.

Before approaching court, both parties agree to attempt:

  2. Mediation
